Psychosocial hazard requirements for Australian hospitality businesses

Under the model Work Health and Safety Regulations, a person conducting a business or undertaking must identify psychosocial hazards, eliminate the risk so far as is reasonably practicable, and where elimination is not possible, minimise the risk using control measures. Since 1 December 2025 these duties have been enforceable in every Australian state and territory. From 1 July 2026, NSW businesses must comply with the approved Code of Practice: Managing psychosocial hazards at work or demonstrate an equivalent standard.

Regulators expect control measures based on the actual risk profile of the work. Generic statements do not satisfy the duty, and higher-order controls that change the work itself are preferred over controls that ask the worker to cope. For a hospitality business, this means the assessment must address the hazards that arise in your workplace rather than describing workplace stress in the abstract.

Psychosocial hazards specific to hospitality

Hospitality concentrates psychosocial risk in the service peak. Understaffing during trade turns ordinary workload into sustained intensity, and split or unpredictable rosters prevent recovery between shifts. Aggression from intoxicated patrons is a foreseeable feature of licensed venues rather than an exceptional event, and close-alone work at the end of trade removes support at the point of highest risk. The workforce skews young and casual, which reduces the likelihood that hazards are reported at all — junior workers frequently do not know what they are entitled to raise. Sexual harassment risk in customer-facing roles is well documented across the sector, and the positive duty under the Sex Discrimination Act now requires employers to take proactive steps rather than respond to complaints.

The 17 psychosocial hazards covered

What documentation a regulator asks for

In a WHS investigation, documentary evidence determines the outcome. Inspectors typically ask for the psychosocial risk assessment, the control measures selected and their position in the hierarchy of controls, evidence of worker consultation, and records showing controls have been reviewed. A statement that the workplace culture is positive is not a defence and does not appear in an audit trail.

Psychosocial hazard kits for hospitality — FAQs

Is a psychosocial risk assessment compliant in my state?

The kits are built to the model WHS framework and the psychosocial hazards Code of Practice, which every Australian state and territory now enforces. Enforceable psychosocial duties have applied nationally since 1 December 2025, and NSW businesses must comply with the approved Code of Practice, or demonstrate an equivalent standard, from 1 July 2026.

How much work is left for me to do?

Roughly 15 per cent. You delete what does not apply to your workplace, add your business name and sign off on the controls. Most businesses finish a kit in an afternoon.

Do I still need a WHS consultant?

Not to produce the documentation. The kits provide the risk assessments, the controls matrix, the SOPs and the policies a regulator asks for, which is the part consultants normally bill 500 or more hours to write.

Why does the kit need to be specific to hospitality?
